Disclosure- For insurance and safety purposes, Global Positioning System (GPS) tracking devices and In-Car Audio and Video Cameras are installed in all Deluxe Transportation Group LLC vehicles.
Purpose and Use- The primary use of these cameras and GPS devices is to assist the company with: driver training, execution of our services, prevention or detection of criminal offenses, defense of legal and traffic claims, and most importantly, the safety and protection of all clients, drivers, and company property. GPS information, video recordings, or audio recordings may also be used as part of an internal investigation of an employee or client. Such investigations shall ONLY be initiated when there is a reasonable belief of management or notification from a driver or customer of any possible misconduct, a breach of health and safety, violation of company policy, or claims of any illegal activities, possessions, or behavior. In such cases, the footage must be requested and reviewed solely by the executive management of the operations and legal department.
Monitoring, Review and Storage- Access to GPS information, as well as video and audio recordings, is limited strictly to applicable Deluxe Transportation Group LLC executive management and Operations management. All drivers, non-relevant company personnel, affiliate partners, and third-party personnel are prohibited from accessing, reviewing, sharing, or deleting such information or footage. Recorded images, video, audio, and GPS information will be subject to appropriate security measures to safeguard against unauthorized access and use.
In cases where recordings or information are used in disciplinary proceedings, client disputes, or for legal claims, it will be retained for as long as necessary to settle such claims or disputes. Employees undergoing disciplinary action will be permitted to see and respond to any recordings or information pertinent to their accusations. NO copies of video or audio recordings or GPS records shall ever be provided for personal possession to an employee, client, affiliate partner, or third party unless legally subpoenaed due to a legal claim.
As required by law, GPS records, video recordings, and audio recordings may be provided to the police (or other applicable governing authorities) with the intention to prosecute for criminal offenses. In defense of legal claims or in pursuance of civil recovery, recordings or records may also be provided to our legal representatives with the intention of presenting evidence before the courts.
Consent and Waivers- By entering any Deluxe Transportation Group LLC vehicle or any vehicle of a Deluxe Transportation Group LLC Affiliate partner, ‘you’ and ‘your guests’ consent to GPS tracking and recording, as well as our in-car safety audio and video recordings for current and all future transactions with the company. All passengers present in any of our vehicles or affiliate partner vehicles release Deluxe Transportation Group LLC®, its officers and employees, affiliate partners, and each and all persons involved from any liability connected with the taking, recording, and storage of GPS, video, and/or sound recordings for current and all future transactions.
By entering any Deluxe Transportation Group LLC vehicle or any vehicle of a Deluxe Transportation Group LLC Affiliate partner, ‘you’ and ‘your guests’ consent to and waive all rights you may have to any claims for privacy, payment, or royalties in connection with any advertising, exhibition of, streaming, webcasting, televising, or other publication of these materials by local or governing authorities or agencies, regardless of the purpose or sponsoring of such exhibiting, broadcasting, webcasting, or other publication irrespective for current and all future transactions.
